1. About these terms

These Terms of Service ("Terms") govern your access to and use of the website at buycarbonoffsets.org and the services offered through it (the "Service"), operated by Agochar Tech LLP ("BuyCarbonOffsets.org", "we", "us"). By using the Service or placing an order, you agree to these Terms. If you do not agree, please do not use the Service.

We offer the Service to individuals and businesses worldwide. Some features (such as subscriptions and business reporting) are subject to additional terms presented at the point of purchase.

2. Key definitions

• Carbon credit — a tradable instrument issued by a registry representing one tonne of CO₂ equivalent avoided or removed.
• Retirement — the permanent cancellation of a credit on a registry so it can never be resold or double-counted.
• Certificate — the branded document we issue confirming a retirement, with a public verification link.
• Pool retirement — credits retired under our name with you noted in the memo field. Named retirement — credits retired with your name on the public registry record.

3. The service we provide

We operate as a carbon-credit aggregator and reseller. We are not a registry, exchange, or project developer, and we do not issue or originate carbon credits. We source verified credits at wholesale from established marketplaces and developers, curate them, retire them on the source registry on your behalf, and issue you a certificate with a public verification link.

You authorise us to purchase and retire credits on your behalf using the details you provide at checkout (including the name to appear on the certificate or, for named retirement, on the registry record).

4. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. One-time purchases can be made as a guest; subscriptions and business features require an account.

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorised use.

5. Orders, pricing & payment

Prices are shown per tonne in your checkout currency — US dollars (USD), or Indian rupees (INR) for purchases billed in India. Each currency has its own price list; INR prices are not a live conversion of the USD price, and the amount shown at checkout is the amount charged. You are responsible for any taxes that apply to your purchase; where Indian GST applies it is included in the INR price shown and itemised on your tax invoice.

Payments are processed by third-party payment providers — Razorpay, Stripe and PayPal. Which one handles your payment depends on your currency and the methods available to you at checkout, and is shown before you pay. We do not store full card numbers. By submitting payment you authorise the processor to charge your selected payment method.

6. Subscriptions

Subscription plans renew automatically each billing cycle (monthly or annually) until cancelled. Annual prepay plans receive the discount shown at purchase. You may pause, change, or cancel a subscription at any time from your account; cancellation stops future renewals but does not reverse credits already retired or generate a refund for the current cycle.

7. Fulfilment & certificates

Most retirements and certificates are completed within hours. Some registries take up to two business days to confirm a retirement; your certificate is issued once the registry confirms it, and shows the actual registry retirement date.

Each certificate carries a unique ID and a public verification page linking to the source registry record. You are responsible for ensuring the name and details you provide for the certificate are correct.

8. Environmental claims

We enable honest contribution claims — for example, that you have funded and retired verified carbon credits. We do not represent that any purchase makes you, your event, product, or business "carbon neutral", "net zero", or "climate positive". Reducing your own emissions should always come first; offsetting addresses the emissions you cannot yet eliminate.

You are responsible for ensuring any public claims you make based on a purchase are accurate and compliant with applicable advertising and consumer-protection rules in your jurisdiction. In particular, from 27 September 2026 EU consumer law (Directive (EU) 2024/825) prohibits claiming that a product has a neutral, reduced or positive climate impact on the basis of offsetting; a certificate from us evidences a retirement, and must not be presented to consumers as making a product, service or event "climate neutral" or "climate compensated".

Partners who place our embed, widget or white-label checkout on their own pages, and resellers of our certificates, agree to the same rule for the claims they and their customers make.

9. Cancellation & refunds

Because credits are purchased and permanently retired on your behalf, an order cannot be refunded once retirement has been submitted to the registry — retirement is irreversible. If you notice an error (for example, a misspelled name or wrong tonnage), contact us as soon as possible and before retirement and we will try to correct it.

Where mandatory consumer law in your jurisdiction provides cancellation or refund rights, your statutory rights are unaffected by this clause.

10. Intellectual property

The Service, including its design, text, logos, and software, is owned by Agochar Tech LLP or its licensors and is protected by intellectual-property laws. We grant you a personal, limited licence to use your certificate and verification page for your own reporting, marketing, and record-keeping. You may not copy, scrape, or resell the Service or its content except as expressly permitted (for example, under a partner or reseller agreement).

11. Acceptable use

You agree not to misuse the Service — including attempting to interfere with its operation, bypass security, submit fraudulent payment details, make false claims using our certificates, or use the Service for any unlawful purpose. We may suspend or terminate access for breach of these Terms.

12. Third-party services & projects

The Service relies on third parties, including payment processors, carbon marketplaces and exchanges (such as Carbonmark, Patch, and Xpansiv), registries (such as Verra, Gold Standard, Puro.earth, and the American Carbon Registry), and independent ratings agencies. We curate carefully, but we do not control these third parties and are not responsible for the underlying performance, validation, or continued integrity of any project or registry.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that any project will perform exactly as projected. Calculator results are directional estimates, not audited figures. 14. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to the Service or any order is limited to the amount you paid for the affected order. We are not liable for indirect, incidental, or consequential losses, or for registry processing delays or third-party failures outside our reasonable control. Nothing in these Terms excludes liability that cannot be excluded by law.

15. Indemnity

You agree to indemnify and hold harmless Agochar Tech LLP from claims arising out of your misuse of the Service, your breach of these Terms, or any inaccurate or misleading environmental claim you make based on a purchase.

16. Governing law & disputes

These Terms are governed by the laws of India, and the courts at Rajkot, Gujarat, India shall have jurisdiction, except where mandatory local consumer-protection law in your country of residence provides otherwise. Agochar Tech LLP is a limited liability partnership registered in India and serves customers worldwide.

17. Changes to these terms

We may update these Terms from time to time. We will post the updated version with a new "last updated" date, and material changes take effect when posted. Your continued use of the Service after changes constitutes acceptance.
